WAGMATCOOK, N.S. - The common-law partner of a Nova Scotia man fatally shot by an RCMP officer in 2008 has agreed to an undisclosed settlement after filing a civil suit against the force.

Patsy MacKay says she can't comment on the amount of money she received through the settlement because it is bound by confidentiality.

John Simon was shot three times by Const. Jeremy Frenette in December 2008 in his home in the First Nations community of Wagmatcook.

Simon, a 44-year-old diabetic who was drinking and off his medication at the time, had refused to leave his home when police approached the residence.

MacKay says the lawsuit was settled at the end of December.
